1. Definitions
- "Wavemere" / "We" / "Us" refers to Wavemere, a yacht tour operator based at 22 Jalan Perdana, 62000 Putrajaya, Malaysia.
- "Guest" / "You" refers to any person who books, enquires about, or participates in a Wavemere tour.
- "Tour" refers to any yacht tour programme offered by Wavemere, as described on the Wavemere website.
- "Booking" refers to a confirmed reservation of a tour following deposit payment.
- "Agreement" refers to these Terms and Conditions, forming the contract between Wavemere and the Guest.
2. Acceptance of Terms
By submitting a booking enquiry, paying a deposit, or participating in a Wavemere tour, you agree to be bound by these Terms and Conditions. The Agreement is formed when Wavemere confirms your booking in writing (email or message).
You must be at least 18 years of age to enter into this Agreement. Bookings on behalf of groups that include minors must be made by a responsible adult who accepts liability for the minors' conduct on board.
3. Service Description
Wavemere operates three yacht tour programmes from Port Klang, Selangor: a half-day coastal transfer, a full-day coastal cruise to Pulau Ketam, and a two-day overnight passage to Port Dickson via Cape Rachado. Full descriptions, inclusions, and pricing are published at waveemel.
Services are available throughout the year, subject to weather conditions and vessel availability. Wavemere reserves the right to modify tour content where circumstances require, provided the material character of the tour is maintained.
4. Bookings and Payment
4.1 Booking Process
Bookings are made by submitting an enquiry via the Wavemere website, telephone, or email. Wavemere will confirm availability and send a booking summary. The booking is confirmed upon receipt of the deposit.
4.2 Deposit and Balance
- A deposit of 30% of the total tour price is required to secure a booking date.
- The balance is due 48 hours before the scheduled departure date.
- Failure to settle the balance within this period may result in cancellation of the booking.
4.3 Payment Methods
Payments are accepted via bank transfer or DuitNow QR. All prices are quoted in Malaysian Ringgit (MYR) and are inclusive of meals and inclusions as described per programme.
5. Cancellation and Rescheduling
5.1 Guest Cancellations
- Cancellations made more than 14 days before departure: full deposit refund
- Cancellations made 7–14 days before departure: 50% of deposit retained
- Cancellations made less than 7 days before departure: deposit forfeited
- Cancellations on the departure day: full tour amount forfeited
Rescheduling requests made more than 7 days before departure will be accommodated subject to availability at no additional charge.
5.2 Weather Cancellations
Where Wavemere cancels a departure due to adverse weather conditions assessed against MMEA bulletins, guests will be offered a full reschedule at no additional cost. No monetary refund is issued for weather cancellations; however, the rescheduled date carries no additional charge.
5.3 Wavemere Cancellations
In the rare event that Wavemere cancels a tour for reasons other than weather (e.g., vessel maintenance emergency), a full refund of all amounts paid will be issued within 10 working days.
6. Guest Responsibilities and Conduct
- Guests must arrive at the departure point at the specified time. Wavemere cannot delay departure for late arrivals.
- Guests must follow all safety instructions given by the crew. Crew instructions regarding life jackets, movement on deck, and anchorage protocols are mandatory.
- Consumption of alcohol in excess that impairs safety or disrupts other guests is not permitted. The captain may refuse departure or disembark a guest at the nearest safe point if conduct endangers safety.
- Guests are responsible for their personal belongings throughout the tour. Wavemere is not liable for loss or damage to personal items.
- Guests must disclose any medical conditions, mobility requirements, or severe allergies at the time of booking.
- Swimming at designated stops is at the guest's own risk. Guests must follow crew guidance on conditions.
7. Health and Safety
All tours operate under the safety requirements of the Marine Department Malaysia (Jabatan Laut Malaysia). Life jackets are provided and must be worn when instructed by crew. Wavemere holds current passenger vessel licences and relevant MMEA approvals.
Guests with significant health conditions, including heart conditions, respiratory conditions, or pregnancy, are advised to consult their physician before booking a sea tour. Wavemere does not provide medical advice and is not liable for health events arising on board.
In the event of a medical emergency at sea, the captain will take appropriate action, which may include returning to port or contacting the Malaysian Maritime Enforcement Agency (MMEA).
8. Intellectual Property
All content on the Wavemere website, including text, images, and tour descriptions, is the property of Wavemere and may not be reproduced, copied, or distributed without prior written consent. Photographs taken by guests during tours may be shared for personal, non-commercial purposes. Use of Wavemere imagery for commercial purposes requires written permission.
9. Disclaimer
Tours are provided as described on the Wavemere website. We do not warrant that specific wildlife, tidal, or weather conditions will occur on any departure. Sandbar accessibility is tide-dependent and cannot be guaranteed. Tour content may be adjusted in good faith where conditions require.
10. Limitation of Liability
To the maximum extent permitted under Malaysian law, Wavemere's total liability to any guest in connection with a tour shall not exceed the amount paid by that guest for the specific tour in question.
Wavemere is not liable for indirect, consequential, or special damages arising from participation in a tour, including travel costs incurred in connection with a weather cancellation or reschedule.
11. Indemnification
Guests agree to indemnify Wavemere against claims, losses, or expenses arising from their own negligence, misconduct, or breach of these Terms and Conditions during participation in a tour.
12. Termination
Wavemere reserves the right to refuse service or disembark a guest at the nearest safe port if that guest's conduct endangers the safety of other guests, crew, or the vessel. In such circumstances, no refund will be provided.
13. Governing Law and Disputes
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or relating to a Wavemere tour booking shall be subject to the jurisdiction of the courts of Malaysia.
In the first instance, Wavemere encourages guests to contact us directly to resolve any concerns. Please write to legal@waveemel and we will aim to respond within 10 working days.
14. Changes to These Terms
Wavemere may update these Terms and Conditions from time to time. The updated version will be published on the Wavemere website with a revised effective date. Bookings made before an update are governed by the Terms in effect at the time of booking, unless the Guest agrees otherwise.
